Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Cliptick mobile application (the "Application").

Your access to and use of the Application is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Application.

1. Agreement to Terms

By using the Application, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not use the Application.

2. The Service

Cliptick is a platform that allows users to generate videos ("Generated Content") through artificial intelligence ("AI") by providing inputs such as text prompts and images. The service operates using credits that are obtained through in-app purchases.

3. User Accounts

Cliptick uses an anonymous authentication system. You are not required to create a traditional email/password account. Your account is associated with your application installation on your device. If you delete the Application, you may lose access to your credits and generated content. You are responsible for safeguarding your account and device.

4. In-App Purchases and Credits

Credits: Video generation within the Application is performed using "Credits" obtained via in-app purchases. Credits are virtual items for use only within Cliptick and have no real-world monetary value.

Payments: All in-app purchases are processed through the Apple App Store and are subject to Apple's terms and conditions of payment.

Refunds: All purchases are final and non-refundable. Any exceptions for refund requests are at the sole discretion of Apple and are subject to its refund policies.

5. User-Generated Content

Ownership: You retain ownership of all your User Content, including the inputs you provide (text, images) and the resulting videos created from those inputs.

Responsibility: You are solely responsible for the content you upload (images, text). You represent and warrant that you own the rights to the images you upload and that your content does not violate copyright, trademark, or privacy rights of any third party.

License Grant to the Service: In order to provide the service to you, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content. This license is granted for the sole purpose of operating, promoting, and improving the Application and providing the video generation service to you. This license includes allowing us to send your content to our third-party AI processing partners, such as fal.ai.

6. Prohibited Activities

You agree not to use the Application to:

• Create content that is unlawful, harmful, threatening, harassing, hateful, or otherwise objectionable.
• Use copyrighted or trademarked materials without having the necessary permissions.
• Create content that contains nudity, pornography, or graphic violence.
• Create content that includes the personal information or likeness of another person without their consent.
• Reverse engineer, decompile, or attempt to hack the Application.

We reserve the right to terminate your access to the service immediately for any violation of these rules.

7. Intellectual Property

The Application itself, including its features, functionality, brand, and user interface, but excluding User Content, is the exclusive property of Cliptick and is protected by copyright and trademark laws.

8. Third-Party Services

Cliptick uses third-party AI services, such as fal.ai, to generate videos. We do not guarantee that the output from these AI models will always be accurate, meet your expectations, or be error-free.

9. Termination

We may terminate or suspend your access to our Application immediately, without prior notice or liability, if you breach these Terms. You can terminate these Terms at any time by deleting the Application from your device.

10. Disclaimer of Warranties

The Application is provided to you "AS IS" and "AS AVAILABLE". We do not warrant that the service will be uninterrupted, secure, or free from errors.

11. Limitation of Liability

In no event shall Cliptick, nor its directors, be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of or inability to use the Application.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will make a reasonable effort to notify you before any new terms take effect.
